RESOLUTION NO.21 OF THE STATE GREAT KHURAL

   This information introduces the new legislation as part of a package of measures taken by the Government to protect the health and income of citizens, save jobs and stimulate the economy during the outbreak of the coronavirus infection.

   The State Great Khural (Parliament) of Mongolia passed Resolution No. 21 on “A set of measures to protect the health and income of citizens, save jobs and stimulate the economy during the outbreak of coronavirus (COVID-19)”, on April 9, 2020 and instructed the Government of Mongolia to develop relevant draft legislation and submit it to the State Great Khural of Mongolia.

   Within the framework of the implementation of this resolution, the required legislations have been approved.

   Within the framework on exemption from social insurance premiums and support from the unemployment insurance fund.

   In connection with the implementation of the above resolution, on April 9, 2020, the “Law on Exemption from Social Insurance Premiums and Support from the Unemployment Insurance Fund” and the “Law on Exemption of Fines and Penalties for payers of Social Insurance Premiums” was approved.

   According to the Law on Exemption from Social Insurance Premiums and Support from the Unemployment Insurance Fund to be exempt from insurance premiums for pensions, benefits, unemployment and industrial accidents and occupational diseases to be paid by the following employers and insured persons from April 1, 2020 to October 1, 2020 and the insured shall be considered to have paid[1] premiums for the same period:

  • Due to the outbreak of coronavirus (hereinafter referred to as “pandemic”), the insured, who works for a legal entity that has lost its function and reduced its income, but has retained its job and submitted a report on payment of social insurance premiums within the legal deadline[2];
  • Mongolian citizen, who has entered into a voluntary insurance policy.

   In connection with the implementation of this law, the Government of Mongolia has approved the “Procedure for Implementation of the Law on Exemption from Social Insurance Premiums and Support from the Unemployment Insurance Fund”[3].

[1] Articles 1 and 2 of the Law on Exemption from Social Insurance Premiums and Support from the Unemployment Insurance Fund. In the case of a voluntary insured the exemption of the insurance premium for pensions, benefits, industrial accidents and occupational diseases shall be equal to the minimum wage and shall be considered to have paid premiums for the same period. 

[2] The following persons are not included: 1. Insured working in public organization;

2. insured working in a state or local owned legal entity with its participation, except for state owned universities and colleges;

3. An insured person whose salary and social insurance premiums are paid from the payment for the performance of goods, works and services with foreign loans and foundations, and international organizations
